It’s wording though is unclear it bans “Any person(s)* who fly/flies a drone without the written consent of the landowner and/or London Borough of Brent, whether licensed or not.”
But if I take of from private land with written permission is it legal in Brent? "and/or’
is ambiguous. surely it should be either ‘and’ OR ‘or’. Do you need both or just landowner permission? I’d guess since Brent can’t regulate the airspace it’s ‘or’, permission of the landowner, presumably whether it’s written or not, since PSPOs AFAIK don’t regulate private property. Further if the land is publicly accessible, until told to leave / not TOAL from it it’s legal whether one has permission or not. Confusing.
Read the key it says number 18 and25 (conflict of interest and open to interpretation) they should make there mind up which for drones so basically just don’t fly over/around Wembley according to the order but if you’re drone is drinking heavily while aggressively begging and handing out leaflets that’ll be a no
It prohibits you from TOAL and operating the drone within that area. But as there is no FRZ in place over the area so you can TOAL and operate the drone from outside it and overfly (within VLOS).
Yep, nothing they can do to stop that, but looking into PSPOs they do apply to private property and authorise private security to issue penalties. Appaling. In practice this means TOALing outside Brent and flying in, unless one has written landowner permsion.
The undeomcratic privatisation of publuc space continues.
@stevesb I’ve wondered about that, are you sure? if private land is publically accessible, you’re allowed to be there until asked to leave. As long as you’re not doing sometbing illegal I don’t see how certain activities are automatically banned. Surely you could have a little dance, whistle a tune, TOAL or do any other lawful activity, unless the landowner says you can’t?
Operators must be aware of their responsibilities regarding operations from private
land and any requirements to obtain the appropriate permission before operating from a
particular site. They must ensure that they observe the relevant trespass laws and do not
unwittingly commit a trespass whilst conducting a flight.
Which means if you conduct the flight without permision, and the owner then comes out and says “I don’t allow drone flights” the fact that there is no signage and you didn’t know that is no defence and means that the flight took place contrary to regulations and therefore was an illegal flight.
