very nice…I had the issue of flying off/landing/flying over NT land…but hey CAP722C 4.3/4.3.1/4.3.2 states that the air space is a “state asset” not a landowner asset and can only impose restrictions on taking off and landing on private property and that even if a UAV geographical zone is implemented the sponsor manages it and does not own it, and this can be rescinded if the landowner abuses it. Further more this malarky about copyright if you photograph or video the external structure is codswallop https://www.legislation.gov.uk/ukpga/1988/48/section/62
you can legally photo/video any external structure that are on public display. But I do like the photos I really should make the effort to get up North. When you live in a place you don’t realise how beautiful it is or the historical/AONB until you leave.
Thanks @anon54870278. I’ve taken quite a few photos of EH/NT sites now, but luckily never been approached and asked to stop what I was doing. Admittedly, I do tend to research a TOAL point beforehand always outside of their land and also tend to fly after hours. The quarry above was different. Plenty of open land and PROWs dotted about. The only place that I wouldn’t have flew from was the car park. Owned by the NT but also with other people using it as a picnic area just not worth the hassle. I would definitely recommend a trip up here, though. Cumbria and the Lake District is a fantastic place!!
@CSB73 i used to live in York, now I live down on the South Coast. Hadrian’s wall was only a couple hours drive from York. My better half has never been further North than Crawley, and so in the next few years I will have to make a concerted effort, and come back North. I agree that it’s always best just to move away from people and have a TOAL point. I used to love going to the Lake District especially the waterfall at Ullswater.
Great photos of a beautiful area. As you say we are best to avoid NT land. Although CAA control the airspace the actual law does state that it is subject to certain existing legislation. In particular the EU regs (which the UK have largely retained) say:
“This (ie the UAS legislation) should be without prejudice to the possibility for Member States to lay down national rules to make subject to certain conditions the operations of unmanned aircraft for reasons falling outside the scope of this Regulation, including environmental protection, public security or protection of privacy and personal data in accordance with the Union law.”
Undoubtedly the NT would argue that this
gives their rules primacy despite the fact they were written in 1965 and the wording sits more comfortably with horse drawn vehicles than drones!
Thanks @aga. Tbh i don’t mind doing a bit research before flying purely to avoid any confrontation with the EH/NT police! You could politely put forward a rock solid defence about overflying at a reasonable height, taking off outside their boundaries, etc but as I have said in a previous thread sometimes certain institutions just can’t be reasoned with. Even if they are quoting/referring to 50 year old legislation!

I had someone come up to me yesterday while I was flying the drone over our roof to chase seagulls off from nesting and was asked what was I doing?
I explained that I was writing a book on the training of seagulls while living in a small fishing village.
The Emmit was duly impressed.
