Pooley Park - Added to Parks and Recreation in West Midlands

I have just added this to the map of places to fly your drone at Drone Scene:

Land owner permission requirements unknown.

Accessibility can be found from a few locations, from pooley park visitors car park or if you fancy a little walk through then you can park up at Alvecote priory and then walk along the canal or through the wooded area

The originator declared that this location was not inside a Flight Restriction Zone at the time of being flown on 12/02/2023. It remains the responsibility of any pilot to check for any changes before flying at the same location.

Just a little heads up on this one. Pooley is under the Warwickshire County Council parks and as such a no drone zone. Like Kingsbury water park. So your TOAL needs to be off the park.there is a bit of a grey area about the canal tow path as a take off area.

I have seen drones up by the gold leaf monument in the past and no pilots to be seen and seen rangers trying to find them.

Such a pity that this park is a fab place for mountain biking so why not drones too. Would
Help on the footfall to this project park for sure.

Having done more research on Warwickshire County run parks, it’s policy, there is no by-law to back it up. So it’s unenforceable.

Whilst the Park Rangers are just told ā€˜no drones’ as far as they are aware, they are just trying to do their job, so my advice is don’t be a smart alec with them and if you’re asked to leave, then leave.

I’ve flown here several times and never even seen a park ranger (I’d be pretty easy to find it was me) unlike Kingsbury (where once I was asked if I’d seen anyone fishing on the river and jokingly said I’ve got my drone in my bag I can cover the ground much quicker than you will on foot hehe) where they are there full time, so I just fly outside of busy hours. No one bats an eyelid.

Same with Canal Trust, it’s a policy as far as I’m aware and not backed up by any by-law. Just be respectful to staff is the least you can do with places that have unenforceable policies.

Interesting fact regarding councils and their ā€œdrone policiesā€.

In an article written by a Barrister: Richard Ryan, he states that their research into 350 Local Authorities showed that the majority did not have any kind of policy in place concerning the use or flying of drones within or over land administered by them and that those few which did have specific policies dealing with the use of UAV’s within their boundaries were not consistent with CAA regulations. To quote Mr. Ryan:

ā€œā€¦ we did not find a single (Local Authority) policy that was accurate: up to date: or enforceable.ā€

He carried on to explain that regardless of the attitudes of Town, Parish, Borough or County councillors - they cannot legally create a by-law that contradicts, or conflicts with Aviation Regulations which were written to definitively govern the use of drones: A drone pilot who abides by CAA regulation cannot be found to be in breach of a local by-law that contradicts rulings already set in existing aviation law as detailed in ANO 2016 and CAP722.

In extreme cases where a Local Authority might insist that its specific by-law supersedes the governance of those regulations enforced under ANO 2016 and CAP722: a case may be brought that a Judicial Review is required in order to ascertain whether the by-law is ultra vires (beyond the remit, power, or scope of authority enjoyed by that organ of Local Government). If ruled to be ultra vires: this means that if a Local Council makes a decision that is beyond their power to make, that action will automatically render that decision invalid and unenforceable.
