Good news! We beat Brighton’s drone ban, and you can fight yours too

Hey Everyone,

Thanks to the respondents, we beat Brighton’s drone ban - for now.

Quick recap: the council wanted a PSPO (Public Spaces Protection Order) making it a criminal offence to take off or land a drone in any council park or open space, with a £100 fine. On 17 September 2026 the Cabinet decided not to adopt it.

It was the most opposed of all 12 PSPOs the council consulted on. Most of the others got 80 to 100% support.

Is your council proposing a PSPO to ban drones? I want to help you fight it. I’m open-sourcing the whole campaign site, so anyone can take it, put it on free hosting, buy a domain, and tweak the content to match their own council’s proposal. The structure, the research approach and the ready-made consultation responses are all reusable.

The site: https://no-drone-ban-brighton.co.uk

If you’re interested, get in touch via the site.

Any council in England and Wales can propose one of these. If you spot one, tell people early, because most of these consultations only get a few dozen responses.

Excellent news! I sent them an FoI request asking for the data behind the proposal. I had an acknowledgement containing a deadline by which they guaranteed a reply and then heard no more. I chased it up with them but no response.

Here’s what I sent to them, feel free to adapt for similar future proposals elsewhere if useful:

I am submitting this as a request under the Freedom of Information Act 2000.

I understand Brighton & Hove City Council is currently consulting on a Public Spaces Protection Order (PSPO) that would restrict drone take-off and landing in council-owned parks and public open spaces.

The cabinet report supporting this proposal refers to a history of drones being flown unsafely, including around children’s playgrounds and recreation areas.

To understand the evidence base for this, please could you provide:

  1. The number of drone-related incidents, complaints, or reports recorded by the council and/or Sussex Police relating to Brighton & Hove for each of the last five years.

  2. For each incident: a brief description of the nature of the incident (e.g. proximity to people, playgrounds, wildlife disturbance, privacy complaint, near-miss with aircraft), and the location (park/open space name, or general area).

  3. Of those incidents, how many involved drones being flown in a manner that did not comply with Civil Aviation Authority (CAA) rules, as opposed to compliant flights that were merely the subject of a complaint.

  4. How many incidents resulted in a police report, a fixed penalty notice, criminal proceedings, or a criminal conviction, and under what legislation.

  5. Any underlying data, reports, or correspondence referenced or relied upon in preparing the cabinet report of 29 June 2026 recommending the drone element of the PSPO.

  6. Whether any alternative approaches were considered before proposing a blanket restriction on take-off and landing (for example, permits for registered CAA operators, or restrictions targeted at specific sites with a demonstrated history of incidents), and if so, why they were not taken forward.

  7. Any equality impact assessment or economic impact assessment carried out in relation to the proposed drone restriction, including consideration of licensed commercial operators.

No answer?! I’d be very interested in seeing the eventual reply.

I have a suspicion this proposed drone ban was based on absolutely no evidence.

After they miss the FOI response deadline, they can be reported to the ICO … where you’ll probably experience a bigger delay as a result of a HUGE backlog. :man_facepalming:

Surprisingly I have just received the following response to my FoI request:

In processing your request, we liaised with colleagues within Community Cohesion as they would hold the information in relation to your request were this information to be held by the council.

We can confirm that the information requested is held by the council. The information you requested is detailed below.

Please note that at the recent BHCC Cabinet Meeting, Members agreed not to proceed with the drone PSPO. In response to your questions:

1. The number of drone-related incidents, complaints, or reports recorded by the council and/or Sussex Police relating to Brighton & Hove for each of the last five years.

Response: None received

2. For each incident: a brief description of the nature of the incident (e.g. proximity to people, playgrounds, wildlife disturbance, privacy complaint, near-miss with aircraft), and the location (park/open space name, or general area).

Response: N/A

3. Of those incidents, how many involved drones being flown in a manner that did not comply with Civil Aviation Authority (CAA) rules, as opposed to compliant flights that were merely the subject of a complaint.

Response: N/A

4. How many incidents resulted in a police report, a fixed penalty notice, criminal proceedings, or a criminal conviction, and under what legislation.

Response: N/A

5. Any underlying data, reports, or correspondence referenced or relied upon in preparing the cabinet report of 29 June 2026 recommending the drone element of the PSPO.

Response: None held

6. Whether any alternative approaches were considered before proposing a blanket restriction on take-off and landing (for example, permits for registered CAA operators, or restrictions targeted at specific sites with a demonstrated history of incidents), and if so, why they were not taken forward.

Response: The PSPO is for no unauthorised drones to take off/land on public open spaces. Drones therefore could be authorised with council permission

7. Any equality impact assessment or economic impact assessment carried out in relation to the proposed drone restriction, including consideration of licensed commercial operators.

Response: No data held

So in five years the council and the police received zero complaints relating to drone-related incidents in Brighton and Hove. Not even one in five years.

So why spend time and money consulting on proposals relating to a problem that doesn’t exist? It’s baffling.

Because the money had been allocated for that purpose, and is therefore spent in connection with with that purpose. I didn’t say it made any sense…

WOW. So the entire proposed ban was based on nothing but… vibes??
