Brill Windmill no fly zone

Deadline has passed and no response or even acknowledgement so I’ve made a formal complaint and request for an internal review.

Oh, now they’ve replied.

Does Brill Parish Council have a byelaw that forms the basis for
enforcement of this policy as described by CAP722D 4.3 “Local Authority
Restrictions”?

Did Brill Parish Council consult the relevant case law regarding the
control of “model aircraft” from council land (most notably Hall v.
Beckenham Corporation 1949) when formulating this policy? Please provide
any documentation to demonstrate the considerations taken with regards to
this case law. - No

Did Brill Parish Council take full consideration in formulating this
policy of all provisions of the Drone Code including those for aircraft
under 250 grams which can be flown without minimum separation distances
from people or property? Similarly, did Brill Parish Council consider
point 9 of the code which would apply to hobbyists with an A2 Certificate
of Competence or are party to Article 16 Operational Authorisation (or
both) which provide for much closer operation of drones and model aircraft
to people and property? No

Please provide any documentation relating to this - N/A

Brill Parish Council’s drone policy prohibits the flying of drones over
council land/property. Please provide the legal considerations the council
took to come to this determination of control of the airspace. The Parish
council did not assess the legal considerations involved

Gotta love it, don’t you.

Local authorities putting signs up saying something is prohibited, and threatening police action, when they haven’t even made a good faith effort to understand the law.

I would hope that your reply will be that their policy is outside the law, and should be removed immediately

Hopefully @Marts will print that out and put on the notice board.
